Terms of Service

These Terms of Service govern the use of Lyvicar, a shop management platform operated by 9499-4852 Québec inc. ("Lyvico", "we"). By creating an account or using the service, you agree to these terms.
1. The service
Lyvicar is cloud software that lets automotive shops manage work orders, appointments, invoicing, inventory, accounting, tire storage and mobile service. The service is offered on a monthly subscription basis.
2. Accounts
You are responsible for keeping your credentials confidential and for all activity on your account. You must provide accurate information when registering and keep it up to date.
3. Subscription and payments
The service is billed monthly in advance through Stripe, our payment processor. Prices are shown before tax; applicable taxes are added based on your province or state. We offer a 14-day free trial; no charge is made during the trial.
3.1 Payments between your shop and your customers
The online payment module lets your shop collect payments from your own customers through Stripe Connect, on your own Stripe account. These transactions take place directly between you and your customers: Lyvico is not a party to these transactions, does not act as a payment processor or custodian of funds, and assumes no responsibility for refunds, chargebacks, disputes, fraud or tax obligations arising from them. By activating this module, you accept the Stripe Connected Account Agreement and Stripe’s terms. Stripe’s processing fees apply to these transactions and are independent of your Lyvicar subscription.
4. Cancellation
You may cancel your subscription at any time from your account. Cancellation stops future renewal. The service remains active until the end of the period already paid, with no refund for the remaining time. There are no fixed-term contracts.
5. Acceptable use
You agree not to use the service for unlawful purposes, not to attempt to breach its security, and not to overload the infrastructure improperly. We reserve the right to suspend accounts that violate these terms.
6. Your data
You retain ownership of the data you enter into the service (customers, vehicles, invoices, etc.). We process it to provide the service, in accordance with our Privacy Policy. We perform daily backups, but you remain responsible for your use of the service.
7. Availability
We strive to keep the service continuously available but do not guarantee uninterrupted operation. We may perform scheduled maintenance and updates. The service is provided "as is", without implied warranties beyond what the law requires.
8. Limitation of liability
To the extent permitted by law, Lyvico shall not be liable for indirect damages, loss of profits or data arising from the use or inability to use the service. Our total liability is limited to the amount you paid in the last twelve months.
9. Changes
We may modify these terms. We will notify you of material changes with reasonable notice. Continued use of the service after a change constitutes acceptance.
10. Governing law
These terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada. Any dispute shall be submitted to the competent courts of Quebec.
